These Terms of Use (“Terms”) govern your use of the LADON messenger website (ladon.app), the LADON messenger waitlist, and the LADON messenger application (together, “LADON messenger” or “the Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

The Service is operated by Albert Gashi, Zürich (Switzerland). Contact: info@ladon.app. See also our Imprint.

2. The Service

LADON messenger is an end-to-end encrypted messaging application for iPhone, offered as a paid monthly subscription. The website at ladon.app provides information about LADON messenger and lets you join the waitlist for the upcoming App Store release.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and legally able to enter into these Terms.

4. Subscription & Payment

LADON messenger is a paid service, offered as an auto-renewing monthly subscription.
The subscription is sold and billed through your Apple App Store account (Apple In-App Purchase). The applicable price is the one shown in the App Store at the time of purchase and may vary by region and over time.
Payment is charged to your Apple ID upon confirmation of purchase. The subscription renews automatically each month unless you cancel it at least 24 hours before the end of the current period.
You manage, cancel, and request refunds for your subscription through your Apple App Store account settings, subject to Apple’s terms and policies. We do not separately process payments or issue refunds.
Apple’s applicable Media Services Terms and Conditions govern all purchases made through the App Store.

5. Waitlist & Newsletter

Joining the waitlist is voluntary and uses a double opt-in: you receive a confirmation email and are only added once you confirm. You can unsubscribe at any time using the link in every email. We handle this data as described in our Privacy Policy.

6. Acceptable Use

You agree to use LADON messenger only for lawful purposes. You must not:

send, store, or share unlawful content, or content that infringes the rights of others;
harass, threaten, abuse, or harm other people;
distribute malware or attempt to compromise the security or integrity of the Service or other users;
circumvent, disable, or reverse-engineer the app’s security mechanisms, except where permitted by mandatory law;
resell, sublicense, or commercially exploit the Service without our written permission;
use the Service in violation of applicable export, sanctions, or encryption laws.

You are solely responsible for the content you send and for your conduct while using the Service.

7. Encryption & No Recovery

LADON messenger is end-to-end encrypted. We cannot read your messages and have no access to your encryption keys, which are generated and stored only on your device. This means that if you lose your device, reset the app, or lose your keys, your messages and data cannot be recovered — not by us and not by anyone else. You are responsible for keeping your device and keys secure.

8. Beta, Availability & Changes

The Service is provided on an “as is” and “as available” basis. The app is under active development and may contain errors or change over time. We do not guarantee uninterrupted, secure, or error-free operation, and we may modify, suspend, or discontinue all or part of the Service at any time.

9. No Warranty

To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose. Mandatory statutory warranty and consumer-protection rights remain unaffected.

10. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data or messages, arising from your use of or inability to use the Service. Nothing in these Terms limits liability for damage caused by intent or gross negligence, or for any liability that cannot be excluded under applicable law.

11. Not for Emergencies

LADON messenger is not designed for emergency communications. Do not rely on it to contact emergency services. In urgent situations, always use the official emergency channels available to you.

12. Intellectual Property

LADON messenger, including its name, logo, software, and content, is protected by intellectual-property rights and remains ours or our licensors’. Your subscription grants you a limited, personal, non-transferable, and revocable license to use the app for its intended purpose. Open-source publication of components is planned.

13. Termination

You may stop using the Service and cancel your subscription at any time through your Apple App Store account. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.

14. Changes to These Terms

We may update these Terms from time to time. We will communicate material changes on our website or via our newsletter. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zürich, Switzerland, to the extent legally permissible. Mandatory consumer-protection provisions of your country of residence remain unaffected.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
